Grounds for Divorce in California
Because California is a no-fault state, it is not necessary for you to provide a reason for the end of your marriage. You only need to state that there are “irreconcilable differences” between you and your spouse, and that there is absolutely no chance of the two of you reuniting. Fault may be considered in certain circumstances, however, such as deciding upon the division of property or awarding spousal support.
You must also fulfill the residency requirement. In California, you must have been a resident for at least six months, as well as a resident of the county where you will be filing for at least three months, all before you can file for divorce.
How Long Does It Take to Finalize a Divorce?
The answer to this lies primarily in each case’s circumstances. It is not easy to put a specific timeline, as one case may have very issues and thus be resolved relatively quickly, in as few as six months. In other scenarios, one case could last up to a year or more when both spouses are unable to come to an agreement on their settlement. At the very least, both parties are required to wait at least six months from the time the receiving spouse responds after being served the divorce papers.
Is California a 50/50 Divorce State?
California is a community property state, which means that all property acquired during the marriage is to be owned equally by both spouses, regardless of who earned it or whose name is on the title.
This means that, generally, when a couple divorces in California, the property will be divided equally. However, there are some exceptions to this rule. For example, property acquired before the marriage or after the separation is not considered community property and will not be divided equally.
Additionally, the court may order a different property division if it finds it equitable to do so.
